In the past 2 weeks I know of 2 DiDs who defended (self rep) AVO actions against them. In both cases the magistrate threw the matter out.

One of the Ex's objected, and was given the option of having the matter heard by a different magistate on the same day. Second magistrate commented "he was leaving, and you got in his face twice!"

That fact that there was a family law case also rated a mention from the bench.

It would be about time that all unsubstantiated allegations were thrown out and the person slapped with the bill for all expenses.
Don't get me wrong I am totally against a man beating a child or woman, but lets face it AVO's and such have been iligally used to seperate parents from children for too long I would even sugest that if a Police officer who investigated and was found derilect in his duties he should be counceled in the corect way of assertaing information.

My recently seperated brother had his 4 boys (aged 6 down) for 16 nights from xmas day until 20th jan,until his wife turned up on his doorstep (the family home)at 2am 1 morning demanding he get out of bed go 2 bank n give her money(large gambling problem)he said no next day she said he was a wife basher n child abuser,in conversation with his solicitor last friday said she was taking out avo on grounds he threatened 2 kill her an his boys,in the same conversation she said she would let him take the boys to church on sunday(cant figure that 1 out) should b a criminal offence to falsely accuse
