Hi all,

I have been subject to an an interim AVO for a couple of months. Each time my case goes to court (for preliminary hearings etc) it gets extended as a further interim AVO. I am concerned that on the final court date, they will give me a final AVO which could last some outrageous length of time - like a year or more.

Seems like these are very blunt instruments at times.

Syd_did we are just at the beginning of this same stupid legal merry-go-round.

Ex wife is able to rock up at court - without us even knowing - hours before access visit, make outragous claims and have an interim order granted because it was supposedly "urgent".

There's no urgency to have our side of the story told. We've just been advised by our lawyer that the claim should be dismissed fairly easily by a magistrate - its now just a matter of when we can get it heard in court. Perhaps maybe not until the new year! That means MONTHS without the kids. Hubby will miss out on having them for Christmas etc - all because the law is a complete joke.

Lawyer is currently trying to get it pushed through quicker, but I won't hold my breath. I'm so disgusted in the system. I wouldn't be surprised if we end up with a situation like yours that keeps getting adjourned.

This is going to cost us thousands of dollars that we don't have. We supposedly can't recover the costs from this b*tch for making these claims. Never mind all the pain and suffering and anguish she's causing to my husband, me, our kids, and their kids over absolutely nothing. (Supposedly it's "violent" to raise your voice at a badly misbehaving child and ask them to respect the rules in your house. Imagine how busy DOCS would be if every parent who tells their kids what to do was investigated?)
